Deliberations have begun in a major legal battle between Elon Musk and OpenAI over the company’s shift from a nonprofit research lab to a profit-driven AI giant.
The trial, taking place in Oakland, California, pits Musk against OpenAI CEO Sam Altman in a dispute over the company’s founding mission and its transformation into a multibillion-dollar firm behind ChatGPT.
Musk argues that OpenAI abandoned its original purpose of developing artificial intelligence for the benefit of humanity and instead moved toward commercial interests backed by major investors.
He also claims his $38 million donation was meant to support a nonprofit structure, not a for-profit model.
OpenAI has pushed back, defending its transition as necessary for global competition in the AI industry and questioning Musk’s claims.
The case also examines whether Musk’s lawsuit, filed in 2024, was brought within the legal time limit. If not, the case could be dismissed.
If it proceeds, the court will decide whether OpenAI misused donations and broke agreements tied to its founding mission.
The outcome could impact OpenAI’s corporate structure, future IPO plans, and partnerships with major investors like Microsoft.
